Lawsuit for food adulteration
2008-01-19 05:56:00 (GMT) (Caymanmama.com - Law News)Kroger Company is in grave trouble nowadays since a Denver man has sued it along with its two more divisions, asserting to claim his rarely found lung illness to the flavoring of artificial butter found in the plants of microwave popcorn.
Wayne Watson has this habit of having two bags of popcorn everyday. The tests conducted inside his kitchen revealed certain diacetyl levels that were quite similar to the ones that factory workers are generally exposed to.
Watson has been diagnosed to be suffering from “popcorn lung”, which is another name for bronchiolitis obliterans. Earlier, this condition has only been discovered among the workers of the popcorn factory who have had great exposure to the toxic chemical flavor diacetyl.
There have already been many lawsuits filed against popcorn companies by the factory workers for heath damages that have been developed by diacetyl. Ten workers of Jasper, Mo. Plant have been listed for lung transplant. Kenneth McClain, Watson’s attorney commented “This is new, but not surprising. Workers at the Jasper plant whose only job was to microwave popcorn in the quality control department got sick, so it’s not surprising that someone like Mr. Watson could be at risk”.
Watson has filed his suit on Tuesday in U.S. District Court. He is looking for unspecified damages.
