A Canadian was fined last Thursday for $500 for his extended stay of around a year in Cayman after the expiry of his work permit.

Jesse Mark Schermann, 22 years old was found guilty for overstaying on 17 January 2008 at Owen Roberts Airport, whereas his authorization to stay had already expired during December 2006.

Nichole Petit, Crown Counsel said Schermann was stopped by the Immigration officers when he was about to depart from the jurisdiction.

The record check revealed the expiry date of Schermann’s work permit to be 20 December 2006. Though he gained an extension till 27 December 2006, but no extension was applied for or granted after this, reported Ms Petit.

Schermann had been working at a restaurant cum bar as the kitchen helper.

Attorney Lee Freeman appealed to Magistrate Grace Donalds for granting the conditional discharge to Schermann. He insisted that Schermann was a college student when he visited Cayman to earn some money. After his arrival, his employer asked for a 12-hour shift or more at the workplace, which was greater than what has been permitted by the Labor Law. Schermann thereby parted with his employer and applied for an extension of seven days. After this, he joined this job at a restaurant cum bar.

Schermann was living with his parents, who work in Cayman. He provided the necessary medical exam along with other documents to his potential employer and continued to wait until he was exasperated in June. When he enquired about the same from his potential employer, he was told that he will be receiving the permit around November.

He finally decided to go home, completely oblivious about the fact that he was staying illegally. At this time he offered his passport at the airport and his actual position was discovered, said Mr. Freeman.
