The “Fake Bad Scale” Test- Test created to see if plaintiffs are lying about their pain, regarding insurance fraud
2008-03-14 20:13:07 (GMT) (Caymanmama.com - Featured Law News)In the past, when someone got into a car accident or even a small fender bender and would come out with no pain or injuries whatsoever, they would still try to gain money from insurance companies by lying about the pain or exaggerating about a very small pain. This form of fraud worked for sometime, however with the “Fake Bad Scale” test, created by psychologist Paul-Lees Haley, there is little room for lies.
The “Fake Bad Scale” is a written test that features forty-three true/false statements that plaintiffs must answer. If they score a twenty-three or greater, they are determined to possibly be lying. Use of this test started sometime around last year, however it has been receiving much criticism lately saying that the test may not be judging plaintiffs fairly.
The test was more recently used in the case about a soldier who served in Iraq and complained he could not get a job when he came back because of the immense stress, and depression that he was going through. When tested on the, “Fake Bad Scale” he was scored as a thirty-two.
