San Antonio, Texas (CaymanMama.com) — The state officers of the SPCA (Society for the Prevention of Cruelty to Animals) have charged a destitute Bronx man on 7 counts of violating a statute of animal cruelty. They stated that due to the negligence of the convicted man, six dogs jumped out of his car and ended up being killed instantly in the heavy traffic of Route 80 in Roxbury.
Lt. Rick Yocum from the SPCA said that they have charged the 68 year old man, James Dannenberg, only after conducting a thorough investigation of the incident. The investigation includes conversations with the police officers, first hand checking of the James’ vehicle and reviewing of the official reports. On June 25, Yocum said that the man created an unfavorable situation for the dogs by putting them in a dangerous situation.
Anybody who tries to carry seven dogs in a car, which are not caged or harnessed, is already inviting disaster. However, a little bit of alertness on the part of the owner could have prevented the accident. Yocum said that if the man is convicted, he will face a hefty fine which could range anywhere from $250 - $1,000 for every offence in addition to community service. The attorney of the dog owner, Stuart Felsen, has called the charge as ‘malicious prosecution.’
Dannenberg was driving a Toyota Camry with 7 non-caged dogs stuffed in it. The officers from the department of Morris County Sheriff noticed that the car was swerving erratically and pulled it over. The authorities said that during this stop, six out of seven dogs jumped out of the car’s window that was covered with a towel and cardboard. Most of the dogs were mixes of German shepherd.
Other charges put against Dannenberg include drunken driving, driving with revoked license, reckless driving and driving with a blocked view. In return, James has filed intent noticed for suing the Department of Morris County Sheriff and state police for unlawful imprisonment and malicious prosecution.
