NBA not entitled to $1.4 million compensation for gambling referre
2008-06-27 17:35:14 (GMT) (Caymanmama.com - News)Providence, Rhode Island (CaymanMama.com) — Last Wednesday, a Brooklyn federal judge indicated that she is ready to considerably cut down the $1.4 million that has been demanded by the National Basketball Association for compensation from Timothy Donaghy, the disgraced referee.
In the contentious hearing that lasted for an hour, adjudicator Carol Amon asserted that she could not understand how the NBA could be reimbursed the total sum of money that Donaghy spent through his illegal gambling. This money was spent by Donaghy in the name of the League and this has made the League accountable for the total sum of money. The NBA also mentioned that it has paid the attorneys more than $200,000 for the administrative costs as well as legal work.
The NBA recently filed a compensation claim against Donaghy for $1.4 million which covers his benefits, salary, and legal expenses as well as other important costs of the League investigation. The NBA has also made a formal request for Donaghy’s being charged in the next month for gambling.
Amon presumed that NBA had filed its request at the last minute. Amon told Paul Schectman, then NBA lawyer, “my concern is this comes late in the game.”
Amon asked the NBA to produce more substantial documents as well as ordered John Lauro, the defense lawyer, to justify in detail many of the compensation claims that the League has demanded.
Amon is still incumbent to give judgment for Dongahy’s benefits and salary that the NBA is asking to recover from him. Schectman also said that accoirding to the legal papers, the league has the right to officially recover the recouping pay that has been due for the year of 2004, 2006 as well as 2007.
Lauro also told Amon about the fact that the league has no right to ask for the recouping pay for the year 2003 as well as 2004. The fact of the matter is that these two years were not a part of charges.
