Largest corn-based manufacturer sued for patent infringement

Washington: Global Bio-Chem Technology Company Limited is one of the largest producers of lysine in China. It is also the largest corn-based integrated manufacturer in Asia. According to a recent report, Ajinomoto Heartland LLC and Ajinomoto Co Inc filed a case against this lysine producer for patent infringement. In today’s hearing, the judge for the Administrative Law held that all claims related to the two patents made by Ajinomoto were proven invalid as they failed to produce documents that disclosed the latest mode of the invention being practiced. This hearing came under Section 337 of the Tariff Act of 1930.

The Administrative Law also ruled that both patents were found unenforceable because of Ajinomoto’s earlier inequitable conduct. The law firms of Mastriani & Schaumberg LLP and Foley Hoag LLP represented the GBT throughout the investigation.

The General Assistant Manger, Li Weignang of Global Bio-Chem Technology Group Company Limited commented, “We are pleased that the ALJ has determined that there was no violation of Section 337. Today’s ruling maintains continued competition in the marketplace, which will benefit American consumers during this time of rising food prices.”
