Imprisoned ill mother set free

Phoenix, Arizona (CaymanMama.com) — An executive from Wall Street who was found guilty of killing her newborn son due to a mental defect will soon be released. As per the nine page decision taken by Richard Price, Justice of the Bronx State Supreme Court, Susan Mooney, 45, will soon be allowed to live with her family free from the Rockland County Psychiatric Center in Orangeburg within 30 days.

Price wrote in the decision that it is the judgment of the  court that the defendant party i.e. Susan Mooney is not suffering from any dangerous mental disability and that she is no longer found to be mentally sick. He further added, “The state has not met its burden of proof by the preponderance of the evidence that the defendant should be retained.”

Price carefully presided for a three day tight retention hearing, which came to an end on May 1. Price thoroughly reviewed the confirmation and declared his final decision after a time period of three months. The State Office of Mental Health and the office of the district attorney have recommended that the defendant remains confined under special care and attention for two more years.

Mooney, the defendant who had a six-figure salary job working as vice president in an investment firm, was found guilty of murdering her son, Mark Ryan Lizardi, due to a mental defect in 2002. Since the crime, Mooney has been diagnosed with breast cancer for which she is being treated now.

Marvin Raskin, Mooney’s attorney, reported that the defendant testified her case in the “most articulate and persuasive manner” in the hearing. Mooney said in front of the court that she was extremely remorseful of her infant’s death. Ruskin further said that Mooney is no longer in need of confinement and that she is in a better mental condition now.
