What is “wrongful termination” and what can I do if I’ve been wrongfully terminated?
In most employment cases and upon beginning with a new company, an employee will be notified that their employment is “at will” and can be fired for any reason or no reason at all. That being said, employers have the disclaimer that there does not have to be “good cause” for firing an employee unless otherwise agreed to or implied by the parties’ conduct. But the reason for termination cannot be illegal or deemed “wrongful.”
How can non-governmental employees know whether or not to file a claim?
Non-governmental employees should consider filing a wrongful termination action if their claim is based on one or more of the following concepts:
- wrongful termination in violation of an express agreement to only fire for cause;
- wrongful termination in violation of an implied agreement to only fire for a cause;
- wrongful termination in violation of public policy and/or in
- wrongful termination in violation of a state or federal statute or constitutional provisions; and
- whistleblowing
If an employee who has been wrongfully terminated was successful in a claim or grievance, they employer may have to pay back wages, fines, and possible punitive damages or the ex-employee can be returned to their job.
