eBay wins UK legal battle against L’Oreal

San Francisco, California (CaymanaMama.com) — Internet marketplace giant eBay won a British court ruling stating it is not liable for counterfeit beauty products to be sold on its site, a clear win against cosmetics company L’Oreal and the suit the waged against the online auction site.
L’Oreal SA took eBay Inc. to court all across Europe, suing in Britain, Germany, France, Belgium and Spain over the sale of bogus fragrances and cosmetics on the eBay site.
L’Oreal alledges there is an growing volume of fake goods being sold to consumers on the site. EBay claims negotiations between the companies regarding the matter desolved as L’Oreal was being unreasonable.
Justice Richard David Arnold’s final ruling in London’s High Court stated that eBay Europe was not to be held liable for trademark infringements committed by its users.
In a statement, eBay said that the ruling was “a victory for consumers and the thousands of entrepreneurs who sell legitimate goods on eBay every day.”
According to the AP, “Earlier this month, a French court ordered L’Oreal and eBay to settle their differences, giving them until May 25 to come up with a mediated settlement. Other cases elsewhere in Europe are still pending.”
