Dallas, Texas (CaymanMama.com) –Following the 42-day reorganization of former struggling automaker Chrysler LLC into a new coalition with Italian automaker, Fiat, the public is now asking hard questions and finding the answers are unacceptable.

The “old” Chrysler company was, and still is referred to as the Chrysler Group LLC but due to the highly publicized bankruptcy filing and new partnership, the auto manufacturer’s liability policies will not be transferred to the new version of the company. Because of this issue, plaintiffs, attorneys and other dissatisfied consumers are encountering a new problem: what, if any, compensation would the thousands drivers and passengers involved in Chrysler related automobile accidents due to defective automobiles obtain?

According to the National Highway Transportation Safety Administration (NHTSA), “3,497 personal injury and wrongful death cases in the past five years had claims that their defective Chrysler vehicles were the cause of these injuries or fatalities.” In addition, U.S. vehicle makers including Chrysler LLC and General Motors Corporation (GM) issued recalls of thousands of defective SUVs and pick-up trucks this year, as per Consumer Reports.

Currently, pending lawsuits filed against Chrysler regarding vehicle malfunctions which has resulted in serious injury and even death equate to approximately $2 billion, according to a report by CNN. Since Chrysler remains a limited liability company (LLC), in the event of a lawsuit, the automaker itself, rather than the vehicle owners would be held liable and sued.

A strange clause in the Supreme Court’s recent bankruptcy approval of Chrysler LLC means all product liability has been dropped. Bottom line, this clause means Chrysler’s remaining assets will most likely be divided among creditors rather than injured Chrysler drivers and passengers, and family members of those victims with product liability claims.
