Wal-Mart to shell out $40M to workers denied pay, breaks

Dayton, Ohio (CaymanMama.com) — Discount retail giant, Wal-Mart Stores Inc. has been ordered to pay a staggering $40 million to some 87,500 Massachusetts workers as part of a class action lawsuit settlement — believed to be one of the largest of its kind in the state — since its filing in 2001.
The lawsuit claims the retailer denied the employees rest breaks and meal breaks, altered time cards and declined to pay overtime, according to court documents obtained on Wednesday.
This settlement comes three months after Wal-Mart came to a deal with Massachusetts prosecutors to shell out $3 million settlement for complaints that it didn’t give its workers proper breaks to eat.
According to the AP, “An affidavit filed Wednesday by plaintiffs attorney Philip Gordon says people who worked for Wal-Mart between August 1995 and this year will receive payments of between $400 and $2,500, depending upon their years of service.”
“It is the largest settlement of any wage and hour class action in the history of Massachusetts, and it dwarfs settlements of similar class actions against Wal-Mart across the country,” Gordon said in an affidavit.
