Ejection Crashes and Related Injury Deaths

Statistics show that ejection during a vehicle accident increases the risk of fatalities and other serious injuries. A number of factors influence the survival rates of accident victims in ejection crashes including the use of safety belts, driving speed, and whether the vehicle rolled over. In cases of rollover car crashes, the risks of severe injury to occupants increase 20 times with ejection.

“A recent study reported a 20-fold increased risk of severe injuries and 91 times greater risk of mortality if an individual is ejected completely from a car crash during an ROC [1]. Accordingly, fatality could be reduced by 70%, if the passengers of the motor vehicles are prevented from sustaining an ejection [2]. Kahane [3] reported that, even in less severe ROCs, two-thirds of the mortalities are attributed to occupant ejection from the vehicle. Also, ejection is a significant source of mortality among children [4].”

The National Highway Traffic Safety Administration says that the use of safety belts reduces the risks of total ejections significantly in motor vehicle crashes. According to the agency’s 2012 Traffic Safety Facts data sheet, “In fatal crashes, 79 percent of passenger vehicle occupants who were totally ejected from vehicles were killed. Seat belts are effective in preventing total ejections: Only 1 percent of the occupants reported to have been using restraints were totally ejected, compared with 30 percent of the unrestrained occupants.”

Ejection Crashes Caused by Driver Negligence

The cause of the aforementioned Houston accident remains under investigation; however, in a number of accidents of this type where vehicle occupants are killed after being ejected driver negligence plays a role. Speeding and driving while under the influence of drugs or alcohol, are among the most common reported factors that are linked to fatal ejection crashes.

In cases where another driver’s bad actions have caused an ejection crash, victims have legal options for recovering damages they incur as a result. Houston based car accident lawyer Amy Witherite says of these types of cases, “I’ve worked with a lot of victims throughout my career who had their lives completely turned upside down due to a driver failing to act responsibly and causing a serious accident where my clients were thrown from a vehicle.”

The attorney says that injured accident victims, or their loved ones in the event of wrongful death, may be due legal compensation for related medical expenses and other damages in these cases. Discussing what legal options are available in their particular case with an experienced attorney is typically a necessary step for obtaining fair financial recovery.
